Bootleg Movies: Are Free Movie Downloads Legal or Illegal?
Many people used to download bootleg movies in the days when free movie downloads were legal: or is it still legal? Nobody really knows. What we do know is that it is not illegal to use P2P file sharing software, but that it is illegal to use it illegally. Confusing? You bet! However, if you keep one single fact in mind then it should all be become clear – well, clearer! It is not legal to download copyright material, whether that is movies, music, games books, articles – anything. That makes sense otherwise copyright laws would be meaningless. What is confusing many people is the focus on two specific forms of download (bootleg movies and music) and on claiming that file sharing is illegal – which it patently is not. Let’s look at each of these in turn. Bootleg movies are free movie downloads of movies that are still protected by copyright. If you are not sure whether a particular movie is protected then if it is a modern blockbuster it is copyrighted. The copyright period used to last for 50 years after the death of the originator, but this has been extended to 70 years, so if a movie or music track was made after 1940 it will be protected and you cannot legally download it unless you pay for it. For work originating before 1940, whether or not it is protected for copying by copyright laws will depend on the date of death of the originator. So, if that was in 1936, the product will have been legally downloadable using peer-to-peer file sharing software since 2006. If the originator died in 1970, then the work will be protected until 2040. So the statements being made that file sharing is illegal are totally erroneous: it is not. It is what P2P software is used to copy and download that is illegal. The problem in making such sweeping statements is that once people have established that one statement is wrong they will naturally begin to question the next. So if file sharing is legal, so too might free movie downloads be legal or even downloading bootleg movies. Not so! Bootleg movies, by their very name, are movies that have been illegally downloaded because these movies come within copyright law: 70 years have not passed since the death of the originator. Of course it doesn’t help that each country has a different definition of copyright and what the period of time is before a movie or music track is not longer protected by copyright. This is becoming such a large problem that there should some unanimity between countries to avoid confusion. Nor does it help for P2P file sharing software to be declared illegal simply because of the way it is used. Should photocopiers be declared illegal because they can be used to copy protected books? By this definition all copying processes should be illegal. It is not the process that is illegal, but the act, and since file sharing is a process and not an act, it is those using the process illegally that should be prosecuted rather than the process banned. Otherwise where do ‘they’ stop? Why should we allow ourselves to be rules by movie moguls and music barons? They brought it upon themselves by a) becoming greedy and extending the copyright period from 50 years to 70, b) targeting kids and their moms rather than the massive Asian producers of copied movies and music and c) focusing on the means of copying rather than the act of doing so. It is legal to use P2P file sharing software to get free movie downloads so long as these movies are no longer protected by copyright law. It is legal to download free music under the same terms. Until the law changes, nobody can claim file sharing to be illegal – it is copying bootleg movies that is illegal. Walt Disney built his empire on bootleg movies: copied from the works of the Brothers Grimm – but after the copyright on their works had lapsed. Seems a bit rich for them to complain about free movie downloads of the very material they copied from the fairy tale writers!
Illegal Music Downloading And Bootleg Movies Are Illegal: Legal Music Download Websites Are Not
Although legal music download websites are not illegal, all illegal music downloading websites and bootleg movies downloaded using file sharing software are said to be. However, the peer to peer software (P2P) is not itself illegal, but the way such file sharing software is used can be illegal. Therefore the so-called ‘illegal’ music download sites can’t in themselves be illegal, just how some people use them. Websites can’t break the law – just people! There is a lot of ‘illegal’ and ‘legal’ mentioned there, and to be frank, people are becoming confused about what they can download and can’t download. The terms used above, using the words ‘illegal music downloading’ and ‘bootleg movies’ are very clear, but what is not clear is why it is still possible to download music and movies without paying for them. You can’t do that with commercial software unless the owner wants it be free. Free movie downloads and free music may not necessarily be illegal, even though you don’t have to pay for them. It might be a case of an artist or composer offering their work free online in order to get their name known – that does happen! When people pay a lifetime subscription to a file sharing network so they can download free movies and free music, they don’t expect to be able to download bootleg movies or download music illegally. They likely believe that the tracks should be protected if they are still under copyright. OK, we all know that’s a silly argument and that any online downloads of modern material is likely to be illegal, but the thing is that it all is not. There are many modern tracks offered as free music downloads by artists and musicians that want to distribute their work free around the web, and those that don’t want to do that should use technology to make illicit downloading of music or movie files impossible. It can be done, so why is not done? In fact, you can download free online movies from illegal music downloading sites (even though there is no such thing) and download free DVD movies from legal download sites. How confusing is that? You can also download games online legally using the same file sharing software as you use to download bootleg movies! Why is all this possible. Keep in mind that P2P file sharing is not illegal but they are trying to make it so to cover up their own ineptitude and lack of technical knowledge. Going back to music, there is P2P software available online now that will inform you if a specific track or album is copyright protected and advise you not to download it. That indicates that not all such software sites are promoting illegal music downloads. It’s your choice whether you break the law or not, as it is in many other choices you have to make in life. Some tracks cannot be downloaded, because it makes use of the capability of modern technology to prevent it. Why don’t all music and movie files use the same protection? That question should be answered by those that always blame the kids for copying what they are able to copy, or download illegal music tracks when they shouldn’t. However, it is surely not them that are costing the industry so much, but those that are involved in illegal music downloading in big way: the Asians that copy them onto CDs and download free DVD movies to sell online. EBay is full of them so why not chase them? You can buy obviously pirated illegal music downloads and bootleg movies from eBay at any time. Why is it that many online software downloads need license keys before they can be downloaded or used, yet no such protection is applied to music or movies – or even game downloads. The file sharing software is not at fault as much as the movie and music companies that allow it to happen. Illegal music downloading and bootleg movies may very well be against the law, but what’s the difference between them and legal music download websites? Surely files can be both copy-protected and download-protected. It’s not true that downloading music is not legal as many claim: downloading copyright protected music certainly is not, but this is a different matter altogether. Don’t blame the software, but blame those that allow it to be possible.

(A) You do whatever you want with and to a software- that includes modifying the software, distributing the software at no cost to be labeled a hero or a genius by others, destroying the software due to its many irritations etc. – since you freed yourself from the ridiculous rules that lure in the software by acquiring the software with your fruits (money) , claiming ownership over it, (B) You torrent software or obtain it from websites where you believe people share software- Many Christians say it’s fine, for it’s Just sharing. In fact, they go as far as stating that software is too expensive and believe that the presence of software hackers is beneficial to those, especially the poor, who want to remain in the software competition – and use a key generator to make the software, such as Windows7, functional, a process that repeats itself across several computers around the globe.

SALT LAKE CITY — A task force led by the Attorney General’s Office investigating crimes by undocumented immigrants discovered over 30,000 illegally pirated media discs and arrested 10 individuals after raiding a warehouse in Salt Lake City last week. The pirated movies, recorded both on CD and DVD format, were estimated to be worth about $350,000 and were allegedly sold by illegal immigrants.The raid was part of an investigation that stems from arrests last year when investigators raided a home where illegal immigrants were allegedly making fraudulent green cards and other illegal documents. “It’s not unusual for us to have a document fraud case turn into a major weapon case, a drug case and in this case obviously pirated CDs and DVDS,” said Kirk Torgenson, chief deputy for the Attorney General’s task force SECURE (Statewide Enforcement of Crimes by Undocumented Residents.) The most recent information led police to raid a home in Ogden and the Produce Express warehouse downtown Salt Lake City on Thursday and Friday of last week. Utah authorities are working with California investigators to possibly arrest a figure higher up in the piracy operation. Two of the Utah suspects already pleaded guilty to copyright infringement charges. They are expected to be deported to Mexico next week. Two others have been arrested only for entering the U.S. illegally, while six others face state charges related to racketeering and forgery. Would it be illegal to buy Spore and then download the cracked version?
I’ve been looking forward to Spore for a long time. I don’t like the thought of piracy, but Spore’s DRM has really made me reluctant to put the game on my computer. So what I was wondering is, could I buy Spore and then download the cracked version to install? Would that be illegal? I mean, I’d own a copy of the game and I would only be playing it on one computer. I just don’t want to be stuck with the crappy DRM. I don’t want to do anything illegal, so I figured I should check before doing it. Does anyone know whether or not it would be illegal to buy the game and then download a cracked version?

When I’m at work, I search for videos on video.google.com. Whenever I find a video that’s hosted on the Google servers, Google provides an option to download it in an iPod compatible format. It seems to me that this practice would either be illegal or at least immoral being that I would be downloading somebody else’s intellectual property for free. But if it is illegal or at least immoral, then why would Google allow it? I’m proud to say that I’ve purchased everything in my iTunes library, I’ve purchased all the (expensive) software on my computer and I’m very much against piracy, but I don’t get this Google download option. Is this illegal, is there a technicality or a loophole I don’t know about or is this actually considered fully legal and moral? I guess I should point out that I’ve purchased ALL of the software on my computer, expensive and not. Slightly misleading. Ha! How’d I miss that typo? I just looked and there IS an option for users to upload videos. So it’s entirely possible (extremely likely, IOW) that there are intellectual property rights infringements going on here. Is the US Customs still searching electronic devices for any illegal files?
Yeah, I’m a 14 year old student and I am migrating to the US with my mom. I have a laptop, which holds lots of data including pictures, documents and other personal stuff. I’ve been researching on the net and found out that the US Customs and border police have full rights to access any and all electronic media, including laptops, iPods and the like. It is possible for them to access all data for suspicious activities such as piracy and pornography. My computer is clean of porn (hated it anyway) but I have some software that are considered pirated. Most of them are video games, but others are really original and I have the DVD. Thing is, I could not bring it as proof, so it stays at home. Other pirated media includes hard-to-find music files and videos, but again, most of them are ripped from my family’s CD collection and could not bring them all as evidence. So, is the US Customs today still randomly searching people’s devices for “homeland security”? How would they even know if the file is pirated or not? Is it possible to have them backed up into an external hard drive and just leave my laptop barren until I get inside the country? Many thanks for answering. EDIT: Sorry for the typo. What are the penalties of owning “incomplete” illegal software files?
I began downloading a game at work, the game is warcraft 3. , work inspectors came in and they checked our computers for illegal software. But i may have still something to defend myself with, because i did not finish the download! You see i use bittorrent, and the download was at 21%, the files come in .iso format, if you open them you get an error because they are incomplete and you cant decompress these incomplete .iso files. This basically means i dont have any illegal software YET, if i did finish the download i believe i could be accused of piracy, but in this particular case im not sure if i can have a way to defend myself. I know what i did is wrong and i do deserve punishment for my actions, but i dont want to cause trouble to the company i work for, therefore i need to defend myself in order to defend the company, right now if im found guilty, i will not suffer any punishment, only my company will… i believe im pretty much fired, but i dont want to cause them trouble… I realize i will definitly lose my job, but it is unfair to this company to be blamed for my actions, i’d like to leave it clear that i regret doing this and i dont mind being fired, i just want the company to avoid any problems. From what the inspector said, even though it is i who downloaded it, the company is responsible because they are the ones who should monitor these actions, since they didnt, they are blamed if i am guilty. What options do i have? they told me the company is responsible but i dont find that fair even though companies should monitor their workers themselves. It is a lesson to me and to my boss. I told him i expect to be fired and he didnt say anything, i just want to help clear my name for the sake of the company. I believe there is light somewhere at the end of this tunnel because there is no actual working software in my computer, its not installed, its just a temporary file in bittorrent folder… Is there any law site i can read to know my options?
